As expected, ACA opponents including the State of Texas find a friendly audience at the Fifth Circuit
Partisan clash over President Obama’s signature health care reform could be on track to be center stage before the SCOTUS in time for the 2020 election
Opponents of the Affordable Care Act found a
receptive audience in the three-judge panel hearing at challenge to the
constitutionality of the nation’s health care law.
Robert Henneke,
general counsel at the Texas Public Policy Foundation,
served as the plaintiffs’ attorney in today’s appeal in New Orleans, which saw
Texas and the federal government on the same side of the case.
The Democratic-led U.S. House of Representatives and
Democratic states argued the individual mandate to buy insurance – which was
struck down in 2017 – could be severed from the current health care law, and
the health care law could continue to stand.
